Terms and Conditions - DD Grocer

 

The below terms and conditions on the use of DD Grocer on MyDDpoints app and DD Grocer web site are applicable to all the MyDDpoints users exploiting DD Grocer function and to all the visitors of DD Grocer web site.

 

1.DEFINITIONS

 

MyDDPoints – A mobile application, that allows its users to earn and redeem loyalty rewards from high street retailers and also place orders to retailers through the app.

DD Grocer – A functionality of MyDDpoints permitting its users to place orders for their grocery needs which is also available as an e-commerce web site.

Site – DD Grocer web site

User – Any person having an account with MyDDpoints points mobile app in their mobile phones or any visitor to DD Grocer web site, who has created an account in DD Grocer web site.

Visitor – Any person visiting DD Grocer web site.

We / Us – Refer to DD Grocer and/ or MyDDpoints collectively or separately as appropriate as used in the sentence.

You – Refer to user/s or visitor/s or anyone reading this terms and conditions collectively or separately as appropriate as used in the sentence.

App – MpDDpoints mobile app.

 

2.TERMS OF USE

 

2.1 Use of and access to DD Grocer

2.1.1 MyDDpoints users can use MyDDpoints to access DD Grocer. Any visitor to DD Grocer web site  can also access DD Grocer via web site. All users can browse and buy goods and services from DD Grocer and manage user account in any of above two platforms but not for any other purpose.

2.1.2 We carry out maintenance on MyDDpoints and site time to time when necessary, which may result in occasional periods of downtime.

2.1.3We can't promise that MyDDpoints and site will be uninterrupted or error-free or that defects in the site will be corrected.

2.2 App/ Site content

2.2.1 We may change the content of the site at any time and may update the site from time to time. However, please note that, we are under no obligation to update the site content upon any changes and any of the content on the site may be out of date at any given time, and. We make no representations, warranties or guarantees, that the content on the site is accurate, complete or up-to-date, although we try to update the information on the site.

2.2.2 We do not guarantee that the site, or any content on it, will be free from errors or omissions.

2.2.3 DD Grocer will automatically own, all rights, including without limitation, any intellectual property rights, of any data on the site, or any part of the site, provided by us or users, or any third party, such as for example shopping lists or favourite items (the data). Users agree that users are not allowed to use the data, or permit any third party to use it, without our express permission. If the law prevents us from automatically owning any rights in the data, you now assign such rights to us.

2.2.4 In order to access the site, users are responsible for configuring their own information technology, computer programmes and platform. You should use your own virus protection software.

2.2.5 Users must not misuse the app and/or site by knowingly introducing trojans, viruses, worms, logic bombs or other material which is malicious or technologically harmful. Users must not attempt to gain unauthorised access to the app or site, the server on which the app/site is stored or any server, computer or database connected to the app/site.

Attacking the web site via a denial-of-service attack or a distributed denial-of service attack falls under breaching the provisions of the Computer Misuse Act 1990 will be a criminal offence under this law. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them if we find you breaching those provisions. In the event of such a breach, your right to use the web site will cease immediately.

2.3 Governing Law

These terms of use are subject to English law and the exclusive jurisdiction of the English courts.

2.4 Privacy policy

2.5 Changes to terms of use

Any changes we make to these terms of use will be conveyed to you as soon as possible by posting those changes on the web site.

 

3.TERMS OF PLACING ORDERS

The following terms apply when you place orders on via our app or site.

3.1 Registered Customer

3.1.1 You must be over 18 years of age, should be within the radius of 10 miles from shop you order from and should have a credit or debit card acceptable to us in your name to place an order on our app/site.

3.1.2 At the time of registering on our app / site you will create a username and password which you must use whenever you shop with us. You must treat your username and password as confidential and must not disclose it to any third party. Please keep this information in a safe place because you will be responsible for all activities and orders made under your password and username. If you think that someone else may either know or be using your username and password, please contact us immediately.

3.1.3 We reserve the right to decline a new customer registration or to suspend or disable your account at any time and at our sole discretion.

 

3.2 Our Contract

3.2.1 Once you placed an order on app/site an acknowledgement will be sent to you showing what you ordered and the price of your order. This is not an order confirmation or acceptance from us. A legally binding contract with you will only arise once we have completed delivery of the goods to you or you (or the person you have requested to collect on your behalf) completed collection of the goods from us. At this time, you become the owner of the goods. This means that you will have no legal liability in connection with your order until Delivery or Collection (as applicable) is completed.

3.2.2 These terms regulate the supply of goods to you by DD Grocer. Any other terms, conditions, or representations (other than those made fraudulently or implied by statute) are excluded.

3.2.3 The failure of us taking any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. We reserve the rights in respect of these terms and conditions at all times.

3.3 Price

3.3.1 The price of the item(s) you order may change any time after you place the order. However, the price applicable to your order will be the price appear on the app/ site at the time you place the order or amend the order.

If a new price or promotion is in place after you place your order which may be advertised on the packaging of goods you have ordered, these prices and promotions will not be applied to your order.

3.3.2 Our app/site gives you the choice of ordering certain items such as fruit and vegetables either by weight or by quantity. Since it is difficult to select loose items such as these to an exact weight, if you order these items by weight you will be charged for the actual weight picked - and our partner stores will always try and get as near as possible to the weight you ordered. Loose items are priced by weight in store, meaning that if you order by quantity and the items picked in store have a higher than average weight, you may be charged more than the guide price given online at time of order. If the items in store have a lower-than-average weight, you may be charged less than the guide price given online at time of order.

3.3.3 All orders placed via app / web are entitled to earn MyDDpoints.

3.4 Quality of Order

The quality of the order you receive depends on the quality standards of the shop you place your order and DD Grocer will not be liable for the quality of the goods you receive. Any complaints about the quality of the goods must be directly dealt with the shop. You may use DD chat option of the app to convey your complaint to the shop.

3.5 Click and collect

3.5.1 Our partner shops will always aim for you to be able to collect your order within the within the time frame agreed with you, but we cannot accept liability if a store provide the goods for collection outside of this timing slot or do not provide all or any of the goods in your collection order.

3.5.2 Ownership of, and risk in, the goods will pass to you once you (or the person you requested to collect on your behalf has) collected your order.

3.6 Use of Cards

3.6.1 If you find your card has been used without your authority, please tell us within 24 hours of finding out. You must also tell your card issuer within the time limits you agree in your card scheme rules.

3.6.2 You must pay for your order using a UK based credit or debit card.

3.6.3 You are required to provide the delivery partner with your national identity card or any other proof of

3.7 Missed Delivery

3.7.1 If the delivery partner attempts to deliver your order and you are not at the address you have stipulated on the agreed day and time you will be charged for any additional delivery that we need to make for that order.
